No, you can sue for as much as you want but the at fault insurance company will likely only have to pay up to a maximum of $100,000.00 because that is the amount of liability coverage purchased by the at fault driver. Good luck with this matter

I suggest that you consult with an attorney in your area that handles this type of property damage matter since whomever you sue will likely come to court with a lawyer and therefore it would be smart for you to also have a lawyer. A lawyer can determine whether you should also sue AAA in addition to Pipers Towing. A lawyer can also figure out the correct court to file the lawsuit. Good luck with this matter.... Read More

Virginia does not allow an insurance company to be sued directly in a motor vehicle collision. The proper parties to sue in your situation would have been you and/or your employer. You should have been properly served with the lawsuit in order for a judgment to be entered against you. In addition, the auto insurance company for the vehicle you were operating should have known about the lawsuit and hired an attorney to defend you.... Read More

The lawsuit is filed against the at fault driver not his/her auto insurance company but send a copy of the lawsuit to the at fault driver's auto insurance company.
The at fault driver (and his auto insurance company) are not responsible for the cost of you hiring an expert.
You are not required to hire an attorney but the auto insurance company will hire an attorney to represent the at fault driver and defend the lawsuit so you might want to consider hiring your own attorney.
Good luck with this matter.... Read More

I do not see how your employer is responsible for what the forklift operator did to damage the bed of your truck even if your were doing the company a favor. Perhaps your employer will pay for damage out of the goodness of their heart but I do not think they are legally obligated to do so. Perhaps your employer's insurance company will cover the claim since you were on company time but I doubt it.
I suggest you find out the name of the insurance company for the brick company and make a claim with that insurance company. Good luck with this matter.... Read More

As I understand it, if you do not have full coverage (e.g. liability and collision coverages) insurance companies will typically reimburse you when you purchase the extra insurance through the rental car company. This is something that you should have discussed with the at fault driver's auto insurance company. Also, keep in mind that before you ever purchase extra insurance on a rental vehicle you should check with you own personal auto insurance company to determine if you actually need to purchase the extra rental car insurance because sometimes your own personal auto insurance company will cover you for any claims that arise while you are using the rental car. Good luck with this matter.... Read More
