This all depends on the terms of the contract - obviously your husband cannot work and its sounds like an issue where there was some form of lien placed on the items which may be subject to "self help" repossession. You will need to retain a lawyer to review what your husband signed and what the other person did to determine whether it was proper or not. ... Read More

Can I sue Office Depot?

Answered 9 years and 3 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Sure - if you want to spend the money to do so - you have that legal right. It will likely cost you several thousand dollars out of pocket to make the point but you certainly can if you think that will solve the issues.

Unfortunately, as a general rule there is no independent legal action for violating HIPAA. Your remedy is to compain to the DOH. There are some instances where such disclosures support other claims but absent significant and provable damages, most lawyers willnot be interested on a contingent fee, leaving you retain a lawyer at an hourly basis. ... The unfortunate aspect of this issue is that the smaller and smaller the amount owed and the harder it is to squeeze the juice the less inclined collections lawyers will be to take such a case without pre-payment of legal fees and not a contingent fee. Noone wants to to the hardest of the collections work for the least amount of money and on one off cases take a risk of non-payment that can't be set off by other business like portfolio collections. ... THIS is why you have laywers on retainer or hired internally ehn you run a business. In this instance, you are likely in the wrong. Your business practices have created whats called an "apparant agency" where you allowed others to assume in the past your benefit they are allowed that same assumption in the future for thiers. You need to work this out or you may find your busines sued in NYwith additonal legal fees added. YOU can then deal with the sub for reimbursement. ... Read More

It appears that you have a claim for breach of contract.  I see no fraud, which would require that the customer intentionally mislead you about his/her intent to fulfill the contract in order to induce you to do the work.  There is no evidence that they did not intend to pay when they made the contract.  Given that you have not delivered any product, what would they have to gain?... Its county court case....over 5k and under 15k. As a general rule, you are wasting your time suing your employers ..who are essentially your customers, unless you REALLY want to ruin your ability to get work in the future. YOu would be better served finding a way to structure your contracts where you don't let someone get $9,000.00 into you for wages or waste your money and time in lawsuits. ... Read More

What can I do if my employer withholds my wages

That you have nowhere to go is of little consquence. If the contract provides 15 days to vacate the contract controls, though regardless you will need to move ASAP as that seems inevitable.

That depends.  Statutes of limitations on breach of contract run from the date of breach, so when was that?  If the money was supposed to be repaid in 2010, it is likely that your limitations period has run out (the NY statute of limitations for breach of contract is 6 years from breach, but it may be shorter in Florida; I've never encountered a limitaitons period for breach of contract which was longer than 6 years from breach).  If, however, the money was not supposed to be repaid (and thus the contract was not breached) until this year, then your claim would not be barred by the statute of limitations, although I can't say what other defenses might apply.... First, you should have addressed this DURING the contract/rental period not store it all up and raise at the end, typically when there are PM fees due. That stated you may have a breach of contract case its just a matter of do you want to the spend the legal fees fighting over the issues. Some people choose to do so out of principle etc. ... Its possble to legally argue there is an enforceable agreement though you will need to decide whether its worth spending the money to hire a lawyer to do so and whether the result is worth it. This is not near as clean as having a signed lease, which you should have had, but there are several arguments that can be raised. ... Read More
