Does he have to pay for the car if she wants it?

In terms of who gets the car in a divorce, either the parties, or their respective counsel, work out an agreement, or if that can not be done, the court will decide who gets the car and who is responsible for the debt. Your first marriage was held to be invalid. At the time you married in the other state, you were single folk who entered into a marriage relationship. When the prior invalidation was removed, you were already in a marriage, but your prior marriage is now held to be valid. Six of one, half dozen of the other. Can US citizens married in the US get divorced in Mexico?

Answered 10 years and 9 months ago by Gisele Kathleen Perryman (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Divorce
If he does, there will likely be jurisdictional issues affecting the validity of the divorce; particularly if the wife has no ties to Mexico. It is not a good idea to divorce when the other party is not given due process, such as if there will be jurisdictional issues or other validity problems. He should consult an attorney in his jurisdiction with particulars.... Read More

How do I begin this divorce process without any money?

Answered 10 years and 10 months ago by Gisele Kathleen Perryman (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Divorce
You can try Legal Aid Services in your area. Also, some law schools or religious charities may have some legal clinics. If not, you can go to a law library and ask for some form books to try on your own. You would have to look for forms that include the petition, summons, temporary relief, and for filing with a pauper's affidavit, among other documents; for samples of what is needed to file. If you wait for your spouse to file, then you may be able to have some relief of the filing fees.... Read More

Can I remarry in another state less than six months after my divorce was finalized?

Answered 10 years and 10 months ago by Gisele Kathleen Perryman (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Divorce
It is not adviseable to do it. You could get married elsewhere, but if you are coming back to Oklahoma, it would not be a valid marriage. However, once the 6 months are up, the new "marriage" could ripen into a common law marriage, if it meets all the other requirements for such a finding. It is just not adviseable to marry before the 6 months are up, particularly if you are planning to keep your home in Oklahoma.... Read More

Can recordings of me with my children be used in court?

Answered 10 years and 11 months ago by Gisele Kathleen Perryman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
It is generally NOT a good idea to do this. You can run into all sorts of privacy and wiretapping issues, particularly if the recording is when the child is talking alone to the other parent. Even if the recording is just between the child and you, questions can come up about the veracity (and the self-serving nature) of the statements, and about whether you prompted or rehearsed the responses with the child (whether or not that is an accurate description of what happened). If you truly believe there is some sort of immediate harm to the children, you should file something in court to deal with the potential harm.... Read More

Yes, you will eventually lose the insurance provided through your husband's work. However, there may be some spousal support options you may be able to obtain through the divorce that could help you financially or with other insurance. Find an attorney in your area for options tailored to your specific circumstances. You may also be eligible for free or low cost representation through your local Legal Aid Society. Good luck.... Did I do anything wrong after the car was grated to me, I went to tag office and had title put in my name?

Answered 11 years ago by Kevin Hunter Pate (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Divorce
Former spouses say a lot of things. On the off chance yours is not a blow hard, keep a certified copy of your decree with you. And be aware that if he makes a false report to law enforcement, that is on him. In that light, unless you can prove he took your tag, leave it as your tag came up missing and when you went to replace it, based on the court order in your divorce, title was transferred at the same time.... Can you get a marriage record sealed from the public?

Answered 11 years ago by Gisele Kathleen Perryman (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Divorce
Sometimes. In US jurisprudence, there is a public interest in a fully open record. However, if you have a very compelling reason that convinces a judge s/he should keep the case sealed, sometimes they will. Usually, though, only parts of a record are sealed, particularly if the issues deal with sensitive subjects, like the privacy of children, the frail, issues regarding third parties not involved in the litigation, or the handicapped, etc....
