Cases of this kind are entirely evidence and fact dependent.  You should contact a lawyer in your jurisdiction in a position to evaluate the facts of your particular case and what evidence you have or can obtain concerning the cause of your injury.

Am I going to jail for something I didn't even do?

Answered 9 years and 7 months ago by attorney William R. Pelger   |   1 Answer   |  Legal Topics: Personal Injury
You need to get a lawyer and don't make any statements to police without your lawyer present. If the story about the friend is true, you will need to give that information to the police.

If you are asking this question, you are in need of an attorney. You have a statute that runs in 2 years, plus, you may be losing the opportunity to preserve evidence. If you don't have an attorney, get one. State Farm has the goal of paying as little as they can for each claim. If they see you are unrepresented, they will take advantage of that.... Read More

Perhaps.  A written waiver of future claims is not favored by the courts, but if written clearly it may be enforced to prevent future claims.  You would really need to examine the language used to be certain that it is written broadly to cover all possible future injuries, claims and damages. Such a waiver will not prevent the filing of a lawsuit, but it may provide evidence that could be used to have the case dismissed at an early stage.  You need to consult with a lawyer regarding this issue.... Should medical bills be negotiated before settlement?

Answered 10 years ago by attorney William R. Pelger   |   1 Answer   |  Legal Topics: Personal Injury
Ask your attorney. It may be very likely that they are settling with 3rd parties who have liens on the proceeds such as medical providers, etc.

No one can answer this without more information. Most of your damages will be compensation from missed work. If you are handling this on your own without knowing whether or not you have fully recovered, you will be waiving your rights to future damages. You should have an attorney look over the whole situation.... Read More

Sounds awful. You might have to hire an attorney to file a petition to open default judgment. I would contact a civil litigation attorney.

If your insurance company won't help you out, be prepared to be sued in civil court. In addition, you may receive a summary traffic fine for driving without insurance, and being in a motor vehicle accident without insurance. They carry fines and driver's license suspensions. Regardless of whether the other driver stopped suddenly, you will be at fault probably more than he or she. If you can afford it I would hire an attorney to see if you have a defense or if there is no defense to try to negotiate your way out of this with a payment plan.... Read More

Do I have law. suite against an automatic door closing on my hand

Answered 10 years and 2 months ago by Craig Markham (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Automatic doors should have safety devices to prevent them from closing if you have not cleared the door's threshold.  Sometimes, these electronic safety devices malfunction or are installed incorrectly.  We would need to investigate the incident to determine what brand and type of safety devices were installed and to determine why those devices did not prevent your injury.  We sould also see if the door had a history of malfunctions and whether the hospital had performed needed maintenance....
