What type of case are you referring to? The title is leaving the scene of a crash. It is up to law enforcement and the local prosecutor to determine if they feel that criminal charges are warranted. You may be a witness to the offense, but it is not up to you whether or not criminal charges are filed.

Trying to predict an outcome of a case is difficult. Especially with only a small picture of what transpired. It sounds like your insurance company is already defending the lawsuit. You can speak with their attorney for some guidance. If you have concerns, you can always hire your own attorney. Overall, the breadth of things to discuss are beyond the scope of this forum.

Most personal injury attorney will work on a contingent fee basis. That means little to no up front costs, and the attorney will only be paid a portion of any recovery. These cases can be very litigious. I recommend speaking an attorney asap.

You can still sue them and collect from any assets that they might have. You can either do this through a personal injury attorney or file your own claim through your local court system. Since your son is 16, the law provides some fairly hefty potential penalties. An adult would likely just get a fine, but your son risks suspension, fine, etc.

You need to retain a lawyer to file suit against your agent for errors and omissions AND a declaratory judgment action against for coverage. My guess is that you will need to come up with a substantial retainer fee for expenses.
Note that if coverage has been denied, you may have BMV issues for violation of Ohio's financial responsibility laws.
Perhaps the "easiest" avenue for you would be if your passengers sued you. At that point your insurance company would likely file a reservation of rights and you could then file a third party complaint regarding the coverage issues.... Read More

You need to get the insurance in place and hope that the Judge will cut you a break. explain all your circumstances. You may have to go through the BMV and pay additional reinstatement fees. I cannot tell you the exact process because I do not have sufficient information.
