Go to the shop, tell whoever is in charge that the car is in your name (bring the title/pink slip if you can), that you paid for all repairs up front (show receipts), and that you demand the return of your car immediately.  You spoke with an attorney, and will proceed to sue the shop if they don't return your property asap.  If they say there are additional charges you haven't paid for, ask them to show you the estimate and evidence of your agreement to pay for said charges.  They can only put a lien on the car if they have unpaid charges, and if you haven't received any bill and agreed to pay for said charges, their lien will be invalid.  Tell them their keeping your property from you is grand theft and can be charged as a felony, and you have the right to sue them in civil court for the value of your car.... You generally don't as it will cost ar more to "sue" than the amount in dispute. If the owner has not abided by the agreement you belive you reached its likely they have a different view. Whether you are bound by arbitration or other limitations will revolve around the terms of the rental you agreed to. It sounds like conversion of your property, which is a damage for the loss of use of your property. Based on the limited information you provided, if it was a bait and switch situation where the dealer advertised a lower price then inflated it, that's a problem that may fit into false advertising.  New York covers that in its General Business Law sections 349 and 350.  It  has to harm the general public.If this is a one time issue, the state attorney general's office website should have complaint forms for car dealers and consumer fraud.  Otherwise, this may be a msall claims case for a breach of contract, but if you paid the price then you may have a hard time claiming you were damaged.   Good Luck!  This is not legal advice nor does it create an attorney client relationship. The problem is what you have is what you have. If you claimed it was 500sq ft of items and it really is 1,400 you don't get to "get over" on the movers and thier contracts are designed that way. What happens with your deposit if it determined that you underestimated the amount of stuff to move is going to be set out in the contract itself. Most such contracts charge for the actual items and are bound by estimates depending on the type of estimate. There are attorneys who handle these kind of things, but you will probably not be able to find one who will do this on a contingency fee. You will have to pay the attorney a retainer fee and pay court costs. Depending on the price paid for the puppy, it may not be worth the expense because you may never collect anything. I suggest reporting this to law enforcement first if you have not done so already. If the person who scammed you is not located in NC you may need to get a lawyer licensed in the state where the scammer is located. If the person is located in NC, even if you win a money judgment, you likely will never collect it. There may be several areas of violation of the law, especially if this was an in home solicitation and/or if everything was done on a talet or other electronic device and you were not sent a copy of what you signed. You can also file a complaint with the North Carolina Attorney general's office. The fact that your husband has a gambling problem or the informaiton can be read in a book, is not going to be of consequence as you will need to show that its an outright scam, such that the representations are utterly false or that they specifically target vulnerable individuals with gambling problems.
