NIce try - but be careful playing the "incompetent grandpa/ma" card as means to get out of contracts on what is really buyers remorse. The immediate response to that when litigation ensues is to seek a mental health examination and if you claim you are too feeble minded to make a contract and doing so is exploitation, you equally feed the notion that you need a guardian at litem to manage your finances and affairs or to be instiutionalized for such. Can't have it both ways where you just play that card everytime you make a deal you don't like. That said, there may be other legitimate issues in regard to the contract that need to be addressed but you will likely need to retain a lawyer to review the documents and intervene. Not likely a fraud case from a general advertisement as it is a general non-specific statment. Absent a written warranty, you might have other remedies such a UCC claims for specificl limited warranty, such as "fitness for use" but the problem there is the expense of hiring a lawyer to sue over the issue and I am willing to bet the vehicle at issuse is a sub$5,000.00 "hooptie" type car with high mileage purchased at a buy here-pay here type dealer. The problem with a cracked head may ultimately come down to what happened when the car "broke down", as hopefully the ECU will not show that you continud to drive the vehicle when the lights came on or when then temperature gauge was in the red. ... Obvioulsy there are other facts in play here that have not been revealed. If you are being accused of fraud you will need to spend the money to lawyer up, with a civil lawyer and possibly an additonal criminal lawyer. Typically these issues occur where your card is used for purchases in a manner that triggers a fraud profile. You can't have it both ways, where you want work performed but refuse to authorize it writing in some fashion. You will need to address this issue with the manufactuer or the warranty company. Obviously you should not be expected to agree in advance that the repair work was properly done, but such verbage on a estimate alone may be of little conseqeuence. Its impossible to address this issue based upon a single sentance cut out of an entire form.... Read More

Otherwise, not sure what would be needed to treat you for being stuck with a syringe that ANY ER wouldnot have the ability to treat and presumably with you working in a medical environment that your employer did nothave treatment supplies on the jobsite. Unless you asked or had the vehicle inspected, they are not required to tell you about damage to the car. The can't defraud or lie about it but they aren't required to do your job as a consumer whcih is to make sure its a good deal. The sort of exception to this is CPO vehicles, where there may be an implied warranty based on the certification representations.
