Call your local state attorney  - there is a packet you canuse to get them prosecuted if they don't make the check good. Now - if this was some Uber thing where you don't have accurate ID on the person and took a personal check - will probably be an expensive learning lesson.

If the Carfax was unaltered - and depending on the papers you signed - AS IS means AS IS....not AS IS unless there are repairs them it means someone else pays for that. Depending on what you want to do you may have a remedy under Fla. Stat. 501.976 BUT you will likely need to retain a lawyer to deal with such an issue and typicially pay out of pocket. ... Read More

Seems like they simply don't  believe you or suspect its some ploy by the "credit management" company to clear your credit. You will likely need to hire a lawyer to sue them for illegal collections efforts assuming your ID theft issue is 100% legitimate.

You should have asked alot of these questions BEFORE you took possession. There nothing wrong with spot sales inherently  - its the use of them to create a Yo-Yo scam that becomes a problem. You may want to hire a lawyer now to intervene and sort the issues out. Unfortunately you will likely have to pay out of pocket BUT the money you spend will likely save you greief and more money in the future. ... Read More

No idea what you are are referencing. In  vacuum, you contact the issuer of the certificate from an independant source and go from there.

YOu will need to hire a lawyer to review the case and see where to go from there. Many times the vehicle is old enough that they are sold with no mileage represented on paperwork. This may be a case under Fla. STat. 501.976 but you will nee to retain a lawyer to pursue such a case.

Seriously? Well, its possible if YOU want to spend the money on such an issue on legal fees to make the point. Otherwise this is simply a customer service issue.

If the paperwork specifically says Nav System is part of that vehicles "trim" then you should be entitled to what you paid for. Bear in mind that the capability is NOT the same as a "subscription". Many cars adverstise "Onstar" but its a subcription service. If there is a dispute over this you may want o retain a lawyer and try to void the deal, espcecially if its seems the dealer is that shady. ... Read More

In theory you can always sue to reolve any dispute - problem here is it will cost far more than the shipping cost and you likely have no other damages to warrant you spending the thousands of dollars in legal fees to file a lawsuit.

This is simply an incoherent stream of babble. You need to either phrase a coherent question or call a lawyer telephonically to explain what you are asking about.

We sue banks and finaincial institutions routinely. This starts as a criminal matter first and foremost for elderly exploitation. An arrest and conviction would go a LONG way to getting a successful resolution with the bank and also provide some useful investigation. Otherwise, its likely to be a difficult case to prosecute against the bank, as its equally possible that the elder person was well aware of what they were doing and complicit in the deal. That a family member later gets involved and cries "foul!" is not an inherent lawsuit against the bank under such circumstances. ... Read More

This is a personal injury case. This known as an "excessive force" secuirty claim. These are VERY difficult to prosecute unless there is a video or substantial injuries inconsistent with reasonable force under the circumstances. can I sue in florida for a scam company from chicago?

Answered 9 years and 3 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
There is noone to sue in such scams as a general rule. You simply got scammed and its unlikely you will ever see a dime. That stated you likely now have an ID theft issue to worry about and need to change all of your contact information and account immediately.

Thier car fax should not differ from your car fax - if they gave you an altered or misrepresented car fax and you can prove it, this would indeed be wrong and a violation of Fla. Stat. 501.976. Otherwise - if you never bothered to have the vehicle inspected and just "assumed" it looked fine - then this will start will falling on your shoulders as a poor consumer choice and possibly a general contract dispute that may be very high risk and low financial reward to pursue. You will need to retain a lawyer to review the paperwork to determine what to do. As to the terms and owing money - absent some unlikely illegality - you agreed to the terms and if they were crappy high interest terms that is clearly your responsibility to negotiate or address at the time of purchase, not after.  ... Not likely as your damages are typically limited to contract type damages. I assume you had the vehicle inspected by an independent inspector such a dealer and took it for a test drive before you bought it? If not that was likely your first and possibly fatal mistake as far and remedies go. Since you also state you have no money you simply are not likely to have a meaningful legal remedy after the fact if you failed to protect yourself properly up front. ... Read More

You will need to get with an ADA lawyer to address these issues. HOWEVER, what you describe sounds like you want to be a professional ADA plaintiff and the purposeful seeking out targets for such lawsuits and claims of money compensation is seriously scrutinized by the courts as it has been equally seriosly abused with opportunistic greed amsquerading as altruism.  ... Can't be both - if the IRS is claiming income that is because there are 1099 debt waivers - this would mean that the debt consolodation people did something but we don't know what. YOumau need to hire a lawyer to sort this out so you know what was actually happening and go from there. ... Read More

Do I have a case

Answered 9 years and 3 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Its not Apples fault that you fell for a scam nor are the obligated "to help you" when you didn't take the time to help yourself. If you didn't think that buying a car with I tunes cards was sent up a red flag of something wrong, you need to be more astute and critical in your decison making. If they have a no refund policy it is what it is. You can try to sell the i tunes cards I guess or use them for some value. At least be happy you learned of the scam before you sent the cards off. ... Read More

Do I have a case

YOu will need to have a lawyer review your contract and see what you signed - if you signed for insurance you won't have much argument about what you were told. If the contract doesnt have insurance or gas obligations then you can dispute with the CC and need to address this with rental company. Most every rental car company has a provison that you must return the car with full tank or replace the gas used or they will re-gas and charge ridiculous rates. ... Read More

The question posed makes little sense, as why would HP beg you to do anything that someone else like Group-on is doing. That stated you need to hire a lawyer to review the facts and your warranty paperwork to determine exactly what has been happening. In the mean time you can report this to the Florida Attorney General - consumer protection section, ... Read More

Problem here is going to revolve around the surveyor report and the advertisement and when you first learned of the issue. Since you have already purchased the yacht you are starting behind the 8 ball most likely as many times there are disclaimers and waivers signed. You will need to retain a contract lawyer or one familiar with yacht sales issues, as this might involve admiralty issues, and go from there. This is not a DIY issue. ... Read More

This will simply have to be addressed in more detail with a lawyer you hire and will revolve around the nature of the item purchased.
