Is there a family lawyer who will represent my girlfriend pro bono?

Answered 13 years and 4 months ago by Helene Thaissa W. Bergman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
Someone has to try to adopt the baby before a court will sign off on relinquishment of the father. If you want to adopt the baby, you could be the person.  Adoption papers are filed, he signs off, etc. Then it can be done. BUT you are then the father for all purposes, including child support if you and girlfriend split up.  Big decision for you to make.... Read More

Answered 13 years and 5 months ago by Mr. Robert Jensen 'Bob' Matlock (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
You should file a motion for enforcement. Judges are obligated to enforce their orders, particularly child support orders. Keep in mind that your ex may file a request to modify the orders as a response to your action. Hiring a lawyer would be a very good idea.

Answered 13 years and 5 months ago by Mr. Howard Gerald Skolnick (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
Yes, you are still married to your spouse.  You are not divorced until the Judge signs the Final Decree of Divorce.  The Final Decree is not truly final and unappealable until 30 days after it is signed.  You must satisfy the Court and provide the Parent Education Course Completion Certificate for both you and your spouse and then approach the Court to grant the divorce and sign the Decree.... Depends on what the new will says, and if the technicalities follow the law. (because it sounds like she wrote the will herself.)  Lawyer needs to look at it and help you decide what to do.

Get a divorce, I would plead both names, in the divorce documents, to make sure you get the divorce and it is valid. Sorry that this happened to you.  Then get his immigration revoked for false pretenses, and fraud.

Can I, as a parent, deny visitation of my child to a grandparent.

Answered 13 years and 5 months ago by Helene Thaissa W. Bergman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
Yes, you can.  Absolutely.  Good reasons to deny unsupervised visits.  Most judges here that I practice in front of, will not allow unsupervised visitation with those circumstances.  If you are in Harris County, call me. I will be happy to assist you.

I am married and was having depression issues, so I cheated on my wife. The other women became pregnant.

Answered 13 years and 5 months ago by Helene Thaissa W. Bergman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
Most definitely.  Your wife might be very upset, but the other woman must allow you to visit, even if you cannot afford much child support and money for the baby's medical bills. If you can put the baby on your health insurance, even, better. Depending on how many other children you have that you are responsible for, will depend on the amount of support you will be ordered to pay. Not too long ago, I represented a man who had two women pregnant at just about the same time.  As in weeks apart.  He is in both of the boys' lives. And he is a super Dad.  ... Read More

Parents have a duty of support until you are emancipated, usually at 18 yrs of age.  Are you still in high school?  Or graduated and have a job. Or married and/or living with someone? Key questions to show whether you are emancipated in the eyes of the law. If so, he can usually throw you out.  Many exceptions to the rule. Disabled, for example.... Read More

Your lawyer should be answering this.  But over ten years is too old to use for impeachment purposes. More important is why you were not in your children's life before now.

Should I add a statement in my divorce that says that my ex husband has to provide a bed for our son when he stays with him?

Answered 13 years and 6 months ago by Ms. Julie H. Quaid (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
It is definitely worth adding a clause in the Decree that states he has to provide your son with a suitable bed. You are correct that it would be difficult to enforce but if it is not in there, you have an even more difficult time making certain that your son is being properly taken care of while with his Father. Please consult with a family lawyer in your area to make sure the Decree has everything in it that needs to be in the document and that the wording is specific and enforceable.  It is well worth your time and money to make certain everything is done correctly in the beginning.    ...
