If I am representing someone in an injury case from a car wreck, I usually explain that we want you to finish medical treatment before we settle the case. The reason is that the 1 time payment from the insurer will be in exchange for a release that says you can never come back for more $. So, we generally want you to be 100% recovered or at the point where the doctors can address any permanent injury, before we settle. This means it is typically a couple of months after you are done treating before we are able to wrap up the case. I am not sure you can make her file a claim with her insurance company.  It would appear that your choice is to pay the repair shop directly or determine whether you personally have any type of insurance coverage that would apply to this type of claim (e.g. auto, umbrella, etc.).  Also, check with the grocery store to find out if it has any type of insurance coverage that would cover you for damaging a vehicle with their grocery cart.  Good luck with this matter.... It depends on whether you are willing to wait 4-6 months for a trial date and then a judge might award you more or less than what the insurance company has offered you.  If the insurance company offered you nothing, then you might as well take the matter to court as you have nothing to lose except your time and expenses of litigation.  Some judges believe in diminished value claims and some do not.  Good luck with this matter....
