You generally don't as it will cost ar more to "sue" than the amount in dispute. If the owner has not abided by the agreement you belive you reached its likely they have a different view. Whether you are bound by arbitration or other limitations will revolve around the terms of the rental you agreed to. If you expect to "sue" then you will need to retain a lawyer to handle this as this is not a DIY project and there are a lot of risks in litigaiton ... Read More

This all revolves around Fla. Stat 507 and the Carmack Amendment. YOu will need to hire a lawyer to address this if there is a controversy. The biggest issue is what kind of estimate were you given as estimates from photos are not the same as an onsite estimate

The problem is what you have is what you have. If you claimed it was 500sq ft of items and it really is 1,400 you don't get to "get over" on the movers and thier contracts are designed that way. What happens with your deposit if it determined that you underestimated the amount of stuff to move is going to be set out in the contract itself. Most such contracts charge for the actual items and are bound by estimates depending on the type of estimate. If the mover is bound the estimate, in most all instances they are going to do an actual onsite inspection. This is all set out in the CARMACK amendment with DOT and Fla. Stat. 507.... Read More

Since you know the customer by name and address this is a classic circumstance for a "cease & desist" letter from a lawyer - demanding they remove the fake review. If they don't you can sue the customer. We have done this for companies before where they respond to the negative review with a screen shot of the lawsuit for others to see so they know you take false claims seriously. ... Read More

There is no lawsuit over this. Its likely an ID theft scam where an illegal used your SSN to get a job. You need to have your tax lawyer/CPA sort this out with IRS.

I was sold a defective boat

Answered 5 years and a month ago by attorney Mark Tischhauser, Esq.   |   1 Answer
This is not a fraud case but an E&O claim against the first surveyors insurance coverage. You need to retain a lawyer to address this depending on the boat value or damages. That you tried to sell the boat 4 months after purchase is going to be a point of interest if the first surveyor claims you damaged the boat somehow... Read More

Its possible. Unfortunately such a case would be very expensive to litigate. The fact that your husband has a gambling problem or the informaiton can be read in a book, is not going to be of consequence as you will need to show that its an outright scam, such that the representations are utterly false or that they specifically target vulnerable individuals with gambling problems. By example, claims that 5 people that took the course made millions of dollars a year, when none did or getting a marketing list from a gamblers anonymous site. If you are willing make the finaincial investment in the litigation you can retain any lawyer that you like to initiate the lawsuit. If you have further questions you can call our office at 813-243-9233 at your convenience. ... Read More

What can I do in this scenario can I sue ledger

Answered 5 years and 2 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
This will likely require you hiring a lawyer to investiaget the issue and see if it can be related to the data breach. The focus will be on whether you did something that gave the thieves access to your accounts as opposed to the company's conduct so that all has ot be sorted out. You will likely need to spend some money to retain a lawyer to pursue such a claim and go from there as most lawyers will not sue online companies on a contingent fee basis. ... Read More

what type of legal council

Answered 5 years and 2 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Probably general civil trial lawyer. This is probably a case where spending some money on a "lawyer letter" may be productive.

You will likely need to hire a lawyer to file a lawsuit to try to secure a judgment against the seller. This may not be cost effective given the value of the car. You can try to file a complaint with local law enforcement if you think it was a fraud scheme and see if they can help but the often claim its a "civil" matter. ... Read More

Fraud on Homeowner's insurance policy

Answered 5 years and 3 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Sorry but there is not a remedy for all issues. If lawyers don't see the merit in the case enough to spend thier money pursuing it, and you don't want to spend your money on the issue you think is so important, it goes nowhere. You will have to decide to spend the money of fold before the case gets dismissed. ... Read More

non refundable deposit refund request

Answered 5 years and 4 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
You likely don't. If its non-refundable and you simply changed your mind late, thats why such provisions exist. That it says it on the reciept and you said nothing at the time when you signed it is a problem. You can try to dispute this with your credit card company and see what they can do, but don't hold your breath. ... Read More

Looking for a lawyer for mal-auto repair

Answered 5 years and 4 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
You will need to have another mechanic determine if this is an issue with the transmission. In the future you want to insist on a written estimate of the work and certainly NEVER agree to work that you can't afford or are willing to pay. That you thought rebuiliding a transmission was $300.00 shows that you really had little idea of the expenses you might incur if the transmission is bad.... Read More

Your failure to find a lawyer is most likely base don financial issues not legal ones. There are plenty of lawyers that will represent you wife if thier fees are paid. That aside, you need to understand that a BK may not affect such a lawsuit as most fraud or punitive damage claims ate exempt from discharge. Make sure you get something in writing from your BK lawyer stating that your discharge applied to the lawsuit claims at issue. ... Read More

Unfortunately, such issues are not likely to be contingent fee cases where the lawyer get paid if you win. You will likely be hiring a lawyer at an hourly rate to initate the litigation and go from there. If you win there is likely an attorney's fee contract provision you can use to argue that you should recover your legal fees from them.... Read More
