It seems like you will need to file litigation against the town.  Its good that you filed the notice of tort claim, but it sounds like you have not gotten any relief.  You need to find an attorney that specializes in land use, and you will need an expert such as an engineer, to help you with your claim.  Good luck. ... I'm not sure why you had to euthanize the dog because of blindness, but in any event, look at the documents that you got form the Pet Smart Vet to find out if you can get your money back for their treatment or evaluation of your dog.  I've never used Pet Smart for this purpose, but I would suspect that they make you sign all kinds of disclaimers before they examine your dog indicating they will not be responsible for any undiagnosed conditions, etc.  Also if the breeder gave you any documentation about the dog, or warranted that the dog was healthy or had been properly vaccinated, then you might be able to get a refund of the purchase price, or first option on a new puppy.  Good luck.... Do I have a worth while case?

Answered 12 years and 7 months ago by attorney Diana L. Anderson   |   1 Answer
Probably not.  You need to be able to prove that the person damaged the items and the value of the items.  If you can prove that, file something in small claims court.  Good luck.

I don't see why it wouldn't be ok - its not gambling or a game of chance, or even spam.  I guess you are going to look at names and addresses of local businesses and send out e-mails?  That would be fine.

Can I sue a liquor store ?

Answered 12 years and 8 months ago by Edward J. Dimon (Unclaimed Profile)   |   1 Answer
The Alcoholic Beverage Commission (ABC) in New Jersey is governed by Title 33 of the New Jersey Statutes Annotated.  In these statutes, there is no mention of prohibition of sale to anyone unless they appear intoxicated or are a minor.  Should they have sold him alcohol and he was obviously intoxicated or a minor, there are criminal statutes that the store would be guilty of violating.  There is no legal precedent to take legal action to prevent a store from selling a lawful item to a lawful customer.  Nor is there any prohibition against selling alcohol on a line of credit, which is essentially what a bar tab / store tab would be.  Unfortunately, that leaves you without a legal solution to this problem.  Should you have ay other questions or concerns, my firm has attorneys who specialize in civil, criminal, family, municipal, elder, commercial, and real estate law.  For more contact information please visit our website at www.cldds.com... How do I keep my mortgage company from charging me for flood insurance that I don't need?

Answered 12 years and 10 months ago by Edward J. Dimon (Unclaimed Profile)   |   1 Answer
this will not be easy to resolve in that the flood maps and zones are not set by FEMA. we are in ocean county and are working with both brick and toms river townships. FEMA has proposed A and V zones which have different requirements. where are you located ? we can help you determine if you are in the flood zone. if you are in a proposed fllod zone, you will need the flood insurance. how much are they charging you for flood insurance ? normally, it is not expensive. ed dimon, esq.... certified letter acceptance

Answered 12 years and 11 months ago by attorney Diana L. Anderson   |   1 Answer
You can't force a person to sign the certified mail.  I would suggest you re-send the letter, and this time ask for a signature.  The post office will try to deliver three times, and if they cannot get a signature, it will be returned to you.  You can then do an affidavit to the court stating that you sent it regular and certified, and the regular did not get returned, but the certified was refused.  If that is not acceptable, the court will tell you and indicate that it has to be served by the Sheriff's Department....
